These Rules and Policies, Waiver, Agreement, and Release of Liability apply to owners, staff, members, clients, guests, and independent contractors.
Privacy Policy:
At REVITALIZE Fitness, we are committed to protecting your privacy and ensuring that your personal information is handled with the utmost care and security. This Privacy Policy outlines how we collect, use, and safeguard your data when you interact with our gym, website, and services. By using our facilities and website, you consent to the practices described in this policy.
Information We Collect:
We may collect personal information from you when you sign up for a membership, attend fitness classes, or interact with our website. This information includes, but is not limited to, your name, contact details, billing information, and emergency contact details. We may also gather data related to your gym usage, such as access logs and security footage for the safety and security of our premises.
How We Use Your Information:
The information we collect is used primarily to provide you with the best possible gym experience, including membership services and fitness classes. We may also use your information regarding special offers, updates, and events related to our gym. Your data is treated with the utmost confidentiality.
Rules and Guidelines:
24-Hour Access: Our gym offers 24-hour access for Level 1, 2 and 3 members with the Brivo mobile pass available via iPhones or Androids. You will receive an email from Brivo with instructions on how to download the free app and how to set up your 24-hour access to our gym. Please be mindful of your fellow gym-goers during late hours and always follow safety protocols. 24-hour gym access is for members only. Guests must check in during business hours and sign a waiver and pay the $15 guest fee. Guests are not allowed after business hours unless approved by the owners Rick and/or Calvin. Do not bring guests after hours unless approved by the owners Rick and/or Calvin. Do not share your 24-hour Brivo mobile pass with others. For your safety and for liability purposes, do not let anyone in afterhours who do not have a Brivo pass. Failure to comply with the rules and policies will result in deactivation of your Brivo mobile pass and cancellation of your membership. Group fitness classes are for members only. Guests must check in prior to the start of each class and sign a waiver and pay the class drop-in fee of $15.
Safety First: Safety is our top priority. Please use equipment with care, follow posted guidelines, and seek assistance from staff if needed.
Cleanliness: Maintain hygiene by wiping down equipment after use with disinfectant wipes and disposing of trash in designated areas.
Noise Level: Be considerate of others by keeping noise to a minimum and refraining from loud conversations.
Dress Code: Wear appropriate workout attire and footwear in all areas of the gym.
Business Hours: 8am to 12pm and 4:30pm to 7:30pm Monday to Thursday; 8am to 12pm on Friday; 8am to 10am on Saturday; CLOSED on Sunday; Gym is always accessible to members with Brivo mobile passes. Guests are not allowed after business hours. 24-Hour access to the Studio is not available.
Children’s Privacy and Guidelines:
Parents and guardians are responsible for supervising and caring for their children at all times while on the gym or studio premises. REVITALIZE Fitness does not provide childcare services, and for the safety and well‑being of all members, children may not be left unattended. Staff members are not responsible for supervising or caring for children at any time. Children under the age of 3 are not permitted in the gym or studio. Children ages 3 to 7 may sit on the stage in the gym or in the designated seating area in the studio while a parent is working out. However, we strongly discourage leaving children unattended. Children ages 8 to 12 must be directly supervised and kept within arm’s reach of a parent or guardian at all times while working out during normal business hours. Running, roaming, or disruptive behavior is not allowed anywhere in the gym, both for the child’s safety and out of respect for other members. Children ages 13 to 15 may work out independently during normal business hours only. Children under the age of 16 are not permitted in the facility during overnight hours unless directly supervised by a parent or guardian. REVITALIZE Fitness reserves the right to make limited exceptions to these rules on a case‑by‑case basis with prior approval from the owners, Rick Anderson and Calvin Bright.
Cancellation, Billing, and Refund Policy:
All sales are final. All purchases made at REVITALIZE Fitness are non‑refundable and non‑transferable.
Members with month‑to‑month contracts are required to provide cancellation notice via email to rick@revitalizefitness.com at least 30 days prior to the debit date to avoid charges for the following month.
Members with one‑year contracts are required to provide cancellation notice via email to rick@revitalizefitness.com at least 30 days prior to the debit date to avoid charges for the following year. One-year contracts will automatically renew for an additional 12‑month term unless cancelled at least 30 days prior to the renewal date. Refunds will apply only to unused months remaining on the one‑year contract after the required documentation listed below has been submitted and approved:
Medical reasons (Physician's note, medical restriction letter, or treatment documentation stating the member cannot safely participate in physical activity)
Relocation more than 25 miles from Revitalize Fitness (See acceptable documentation list below)
Military deployment (Deployment orders, PCS orders, or a letter from the member's commanding officer)
Death (Death certificate, obituary, funeral program, or executor documentation)
Acceptable Documentation for Relocation:
To qualify for a relocation‑based refund, members must provide official documentation showing a new residential address outside a 25‑mile radius. Acceptable forms of documentation include:
A USPS change-of-address confirmation
A new lease agreement or mortgage statement
A utility activation letter (electric, water, gas, or internet) showing the new address
An employer transfer letter such as a Permanent Change of Station military orders (PCS)
A driver's license update receipt
Moving receipts (U‑Haul, Penske, etc.) are not accepted as standalone proof of relocation
Refunds will apply only to unused months remaining on the one‑year contract after the required documentation has been submitted and approved
Returned Fee and Late Fee:
All returned credit card, debit card, and EFT items will incur a $25.00 service fee. A $9.00 late fee will be charged for every 10‑day period an account remains past due.
Waiver, Release of Liability and Policy Agreement:
You and the person(s) on your account have agreed to purchase a gym membership or a guest pass at a facility that allows you access at any time. As such, you and the person(s) on your account are aware that there will be no supervision or assistance outside of normal business hours. Hours of operations are posted online on our website and on our main door. You and the person(s) on your account are also aware that if you are injured, become unconscious, suffer a stroke, or heart attack, there will be no one in the fitness center after hours to respond to your emergency, and this facility has no duty to aid you. Even though this facility is equipped with surveillance cameras, it is likely that should you require immediate assistance, none will be provided. We HIGHLY recommend that you have a workout partner who’s also a REVITALIZEFitness member that can accompany you while at the fitness center after hours. Always keep your phone with you and dial 911 if an emergency arises. Press the emergency button located on the right-side wall if you need emergency assistance. Children under the age of 16 must always be accompanied and supervised by a parent or guardian after business hours. The group fitness Studio on 510 East Main Street is not available for 24-hour entry.
Because physical exercise can be strenuous and subject to the risk of severe injury, the club urges you and the person(s) on your account to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You and the person(s) on your account agree that if you engage in any physical exercise or activity or use any club amenity on the premises or off premises or off premises including any sponsored club event, you do so entirely at your own risk. You and the person(s) on your account agree that you are voluntarily participating in the use of this facility and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.
You and the person(s) on your account will have access to the fitness center 24 hours a day via the Brivo mobile pass. Once payment is received, you will receive an email from Brivo with instructions to download the free app from your app store. Once the app is downloaded and installed, follow the steps on how to activate your door pass. All guests must check-in between 8am to 12pm and 4:30pm to 7:30pm Monday to Thursday, 8am to 12pm on Friday, and 8am to 10am on Saturday, sign their own waivers, and pay the drop-in fee of $15 per person per visit OR check-in with Rick Anderson after hours via email at rick@revitalizefitness.com, sign the waiver electronically, and pay the drop-in fee of $15 via Venmo or Zelle. Your Brivo mobile pass belongs to you. DO NOT share your Brivo mobile pass with anyone. We are closed on Sundays. Guests are not allowed after business hours.
This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment and (c) your slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas.
You and the person(s) on your account acknowledge that you have carefully read this "waiver, release of liability, and policy agreement" and fully understand this contract. You and the person(s) on your account are to release and discharge REVITALIZE Fitness, REVITALIZE Health and Nutrition, MAHJK LLC, 508 Kramer LLC, Nicole J & Co Marketing Group, the Bistro Tropical, and all affiliates, employees, agents, representatives, successors, volunteers or assigns, from all claims or causes of action. You and the person(s) on your account agree to voluntarily give up and waive any right that you may otherwise have to bring legal action against REVITALIZE Fitness, REVITALIZE Health and Nutrition, MAHJK LLC, 508 Kramer LLC, Nicole J & Co Marketing Group, the Bistro Tropical, and all affiliates, employees, agents, representatives, successors, volunteers or assigns for negligence, personal injury, or property damage.
You and the person(s) on your account have agreed to give REVITALIZE Fitness and Nicole J & Co Marketing Group permission to use photographs and/or videos of yourself and everyone on your account for promotional and educational purposes on our social media platforms and websites.
We have two locations downtown. The Gym is located on 515 East Main Street, and the group fitness Studio is located on 510 East Main Street right across the street. Some classes will be in the gym, and some will be in the Studio. Fitness classes are for members only. Non-members can pay a drop-in fee of $15 per class per visit.
Your privacy and adherence to our gym rules are essential to maintain a safe and welcoming environment for all members. We may update our policies from time to time, so please review this policy periodically. If you have any questions or concerns about your privacy or our gym rules, please don't hesitate to contact us.
Discrimination Policy:
Purpose:REVITALIZE Fitness is committed to providing a safe, inclusive, and respectful environment for all employees, members, and visitors. This policy aims to prevent and address any form of discrimination within our organization.
Scope: This policy applies to all employees, members, visitors, contractors, and any other individuals associated with REVITALIZE Fitness.
Policy Statement:REVITALIZE Fitness strictly prohibits any form of discrimination based on race, color, religion, sex, gender identity, sexual orientation, national origin, age, disability, or any other characteristic protected by law. Discriminatory remarks, actions, or behaviors will not be tolerated under any circumstances.
Definitions:
Discrimination: Unfair or unequal treatment of an individual or group based on protected characteristics.
Harassment: Unwelcome conduct that creates a hostile, intimidating, or offensive environment.
Retaliation: Adverse actions taken against an individual for reporting discrimination or participating in an investigation.
Responsibilities:
Employees: All employees and contractors are responsible for maintaining a respectful and inclusive environment. Employees must report any incidents of discrimination or harassment to their supervisor or the Human Resources department.
Management: Managers and supervisors are responsible for enforcing this policy and addressing any reported incidents promptly and fairly.
Human Resources: The HR department is responsible for investigating reports of discrimination and ensuring appropriate actions are taken.
Reporting Procedures:
Immediate Action: Any individual who experienced or witnessed discrimination should report the incident immediately to their supervisor or the HR department.
Investigation: The HR department will conduct a thorough and confidential investigation of the reported incident.
Resolution: Appropriate actions will be taken based on the findings of the investigation. This may include disciplinary measures, up to and including termination of employment or membership.
Confidentiality: All reports of discrimination will be handled with the utmost confidentiality. Information will only be shared on a need-to-know basis to conduct a thorough investigation and take appropriate actions.
Non-Retaliation:REVITALIZE Fitness strictly prohibits retaliation against any individual who reports discrimination or participates in an investigation. Any form of retaliation will be subject to disciplinary action.
Training and Awareness: All employees will receive training on this discrimination policy and their responsibilities in maintaining a respectful and inclusive environment. Regular awareness programs will be conducted to reinforce the importance of this policy.
Review and Updates: This policy will be reviewed annually and updated as necessary to ensure compliance with applicable laws and regulations.
REVITALIZE Fitness: Infrared Sauna – Liability Waiver & Acknowledgment of Policies
By booking this service, you acknowledge and agree to the REVITALIZE Fitness Infrared Sauna Liability Waiver. This serves as your digital signature agreeing to the waiver.
1. Assumption of Risk
Using an infrared sauna involves exposure to elevated temperatures, which may cause dehydration, dizziness, lightheadedness, nausea, increased heart rate, or other physical discomfort. Certain medical conditions, including cardiovascular issues, respiratory conditions, heat sensitivity, pregnancy, and chronic illnesses—may increase these risks. I voluntarily choose to use the infrared sauna and accept full responsibility for any risks, injuries, or complications that may occur.
2. Health & Medication Disclosure
I understand and agree with the following:
The use of drugs, alcohol, or impairing medications before or during a sauna session may lead to dizziness, fainting, or loss of consciousness.
If I am taking any medication, I will consult my physician or pharmacist before using the sauna.
If I am pregnant or suspect I may be pregnant, I will consult my physician prior to use, as elevated body temperatures may pose risks during early pregnancy.
If I have any doubt about my ability to safely use the sauna, I will consult a physician before participating.
3. Age Requirements
No one under the age of 18 is permitted in the infrared sauna unless accompanied by a supervising adult.
4. Personal Responsibility During Use
I agree to stay hydrated before and after each session, follow all posted rules and staff instructions, and discontinue use immediately if I feel light‑headed, dizzy, overheated, or unwell. I understand that sauna sessions must be limited to no more than 45 minutes, and temperatures must remain below 150°F. I will not bring plastic water bottles into the sauna.
I acknowledge that each infrared sauna session is designated for a single individual. Every person must reserve their own session, regardless of whether multiple individuals intend to use the sauna concurrently. I understand that sharing a session, permitting another person to enter under my reservation, or admitting any unregistered guest into the sauna is strictly prohibited.
5. Facility Policies
Sauna add‑on memberships require a minimum 3‑month commitment. Early cancellation is not permitted.
All sessions must be booked in person or by phone.
Sessions reset every 30 days; no rollovers.
Sessions are non‑transferable.
A 24‑hour cancellation policy applies. A $25 fee will be charged for no-shows.
No refunds; all sales are final.
A Brivo access card is required for entry.
6. Privacy and Emergency Access
I understand that the sauna room remains locked during my session to ensure privacy. I acknowledge and agree that REVITALIZE Fitness staff retain a master key and may enter the sauna room only in the event of an emergency, including but not limited to concerns for my safety, signs of distress, equipment malfunction, or failure to respond to staff attempts to contact me. This access is solely for safety and operational reasons.
7. Release of Liability
I acknowledge and voluntarily assume the risk of injury, accident, or death that may arise from the use of the infrared sauna. I, on behalf of myself and my heirs, executors, representatives, and assignees, waive and release all claims or liabilities for personal injury or property damage of any kind sustained while on the premises or during sauna use, including any advice provided by staff, contractors, or representatives. In consideration of being permitted to use the infrared sauna at REVITALIZE Fitness, I release and hold harmless REVITALIZE Fitness, its owners, staff, contractors, and affiliates from any and all liability, claims, demands, or causes of action arising from my use of the sauna, including but not limited to injury, illness, or property damage. This release applies to all ordinary risks associated with sauna use, whether foreseeable or unforeseeable. This waiver applies to all current and future sauna sessions and remains in effect unless revoked in writing by either party.
8. Acknowledgment
By booking this service, I confirm that I have read, understand, and agree to all terms of this waiver and all sauna policies. I understand that failure to follow these rules may result in suspension or termination of sauna privileges. I acknowledge and agree to the REVITALIZE Fitness Infrared Sauna Liability Waiver. This serves as my digital signature agreeing to the waiver.
SilverSneakers and Prime Fitness Waiver and Assumption of Risk
Please consult with your physician before beginning any exercise program.
I acknowledge that I have voluntarily chosen to participate in one or more physical exercise or fitness activity or sport programs (the "Programs"). I acknowledge (i) the nature of the risks of the particular Programs in which I have chosen to participate, and (ii) the strenuous nature of those Programs. I understand, for example, the risks associated with physical injury, abnormal blood pressure, heart attack and even death; as well as the risks associated with the negligence of a Tivity Health Services, LLC participating location and any other organization or individual participating or involved in providing or promoting any classes, functions, Programs, testing, or other activities that I participate in as a Tivity HealthTM Program member (including without limitation the owners, officers, directors, employees, and representatives of any of the foregoing).
By signing this document, I expressly assume all risk for my health and well-being and expressly assume the other risks associated with participating in the Programs, including, but not limited to, the negligence of a Tivity Health participating location and any other organization or individual participating or involved in providing or promoting any classes, functions, Programs, testing, or other activities that I participate in as a Tivity Health Program member (including without limitation the owners, officers, directors, employees, and representatives of the foregoing).
I also hereby release, waive, discharge and covenant not to sue any class instructor, any Tivity Health participating location, any sponsoring organization, Tivity Health, Inc., or any of their subsidiaries or any other organization or individual providing or promoting classes, functions, Programs, testing, or other activities that I participated in as a Tivity Health Program member (including without limitation the owners, officers, directors, employees, and representatives of any of the foregoing) at any time hereafter, from any and all demands, liabilities, losses, or damages (including death, bodily injury or damage to property) caused or alleged to be caused in whole or in part by the negligence of any of the foregoing people or entities. In addition, I agree that Tivity Health may engage in – and I hereby expressly consent to – (i) the recording (in video and/or still photo format) of my participation in Tivity Health classes, workshops or other programs, and (ii) the publication or other use by Tivity Health of any such recordings in social media, broadcast media, print media, general advertising and similar purposes.
I have read and understand this waiver and express assumption of risk. I have also read, understand, and will adhere to all guidelines and policies in regard to this benefit. This waiver and release shall survive the term of any agreement with a Tivity Health participating location or individual.
In the event that my physician has recommended any limitations to my physical activity or I have experienced any of the following conditions, I hereby attest that I have informed my physician of the condition(s) and have obtained express consent from my physician to participate in the Programs.
• Chest pains while at rest and/or during exertion, previous heart attack or high blood pressure
• Any heart or circulatory conditions, such as vascular disease, stroke, chest pain, congestive heart failure, poor circulation to the legs, valvular heart disease, blood clots
• Frequent fast, irregular heartbeats OR very slow heartbeats
• Diabetes
• Previous hip or spinal fracture (as an adult)
• Lung disease or shortness of breath after mild exertion, at rest, or in bed
• Open cuts on my feet that do not seem to heal
• An unexplained weight loss of ten (10) pounds or more in the past six (6) months
• More than two falls in the past year (no matter what the reason)
• More than one year since I have engaged in regular physical activity
AUTHORIZATION: I/We hereby authorize any medical treatment deemed necessary in the event of any injury while participating in any activities at REVITALIZE Fitness the gym and/or the studio. I/We have appropriate insurance or, in its absence, agree to pay all costs as may be incurred on my/our behalf. Failure to comply with this waiver, release of liability and policy agreement will result in deactivation of our 24-hour Brivo mobile passes and termination of our membership. Should a court of law find any part of this agreement to be against public policy or in violation of any state statute or ease precedence, then only that wording is removed, and the remainder of this agreement will remain in full force.
